By using our commercial property tenant-finding service, you agree to the following Terms and Conditions.

1. Commercial Property Search Service

Cryptic Property helps tenants find commercial properties based on their business needs, preferred location, budget, property size, and intended use. Properties may include shops, showrooms, offices, commercial halls, warehouses, and other business premises.

We shortlist available options and coordinate with property owners or their authorized representatives. The final decision to rent a property rests with the tenant and the owner.

2. Brokerage and Service Charges

For successfully arranging a commercial tenancy, Cryptic Property charges a service fee equivalent to one month’s finalized monthly rent.

For example, if the agreed monthly rent is ₹20,000, the brokerage payable to Cryptic Property will be ₹20,000, plus applicable taxes, if any.

The brokerage terms will be communicated to the tenant before the property-hunting service begins.

3. When Does Brokerage Become Payable?

The brokerage becomes payable when the tenant and property owner mutually finalize the rental transaction through Cryptic Property’s assistance.

This obligation arises when both parties confirm their agreement to rent the property, whether verbally or in writing, subject to applicable law and the evidence of the agreed terms. Payment is due at the time of finalization, even if the written rental agreement is signed later.

If the tenant and owner complete the rental transaction directly after being introduced to the property by Cryptic Property, the agreed brokerage remains payable.

4. Property Visit Charges

Separate property visit charges may apply depending on the property’s location, distance, and visit arrangements. Any applicable charges will be communicated to the tenant in advance and require the tenant’s agreement before the visit is arranged.

Visit charges are separate from brokerage and will not be adjusted against the brokerage fee unless agreed otherwise in writing.

5. Rent Negotiation

Cryptic Property assists tenants and property owners in negotiating monthly rent, security deposit, maintenance charges, lease duration, lock-in period, and other rental conditions.

All terms are subject to mutual agreement between the tenant and property owner. Cryptic Property does not determine the final rent or guarantee that a particular negotiation will succeed.

6. Rental Agreement and Documentation

Cryptic Property may coordinate communication and assist with rental agreement formalities. The tenant and property owner are responsible for reviewing and approving the agreement before signing.

Stamp duty, registration charges, legal drafting fees, and other documentation expenses will be paid by the relevant party or parties as mutually agreed.

The tenant and owner should independently verify property ownership, the owner’s authority to rent the premises, permitted commercial use, and any required approvals before entering into a tenancy.

7. Property Availability and Information

Commercial property availability, rental prices, and other details may change without notice. We make reasonable efforts to share relevant information, but tenants should independently verify important property details before making financial commitments.

Cryptic Property does not guarantee the availability of every property or the suitability of a property for a particular business.

8. Tenant Responsibilities

Tenants should provide accurate information about their business, budget, preferred location, space requirements, and intended use of the premises. They should attend scheduled visits on time and communicate any change in requirements promptly.

Tenants must not deliberately bypass the agreed brokerage by completing a rental transaction directly with an owner after being introduced to the property through Cryptic Property.

9. Cancellation and Changes

Property visits, negotiations, and rental arrangements may be changed or cancelled depending on the circumstances. Any agreed visit charges and brokerage obligations already arising from a finalized transaction will be handled according to the terms accepted by the parties and applicable law.

If a rental transaction is not finalized, brokerage is not payable merely because a property was shown, unless a separate lawful written agreement expressly provides otherwise.

10. Limitation of Service

Cryptic Property acts as a property-finding and rental facilitation service. The tenant and property owner remain responsible for their respective decisions, obligations, payments, and compliance with applicable laws and contractual terms.

11. Acceptance of Terms and Conditions

By requesting commercial property search services from Cryptic Property, the tenant acknowledges these Terms and Conditions, including the brokerage fee of one month’s finalized rent and any separately agreed property visit charges.

For transparency, the brokerage amount and applicable visit charges should be confirmed in writing before the relevant service is provided.
